Al registrarse y utilizar HABLALO (el "Servicio"), usted ("Cliente") acepta quedar vinculado por estos Términos de Servicio. Si no está de acuerdo con alguno de estos términos, no utilice el Servicio. Estos términos constituyen un acuerdo legal entre el Cliente y Francisco Javier Jaramillo LLC, operando bajo el nombre comercial Gain With Media, con sede en St. Augustine, Florida, USA.
HABLALO es una plataforma de automatización de WhatsApp Business que permite a negocios conectar su número de WhatsApp Business a herramientas de automatización, incluyendo respuestas mediante inteligencia artificial, gestión de conversaciones, plantillas de mensajes y asignación de agentes humanos. El Servicio opera a través de la WhatsApp Business Cloud API provista por Meta Platforms, Inc.
Para usar HABLALO el Cliente debe: (a) ser una entidad legal o persona con capacidad contractual plena; (b) tener al menos 18 años de edad; (c) poseer o tener autorización para usar el número de WhatsApp Business registrado; (d) cumplir con las Políticas de la Plataforma WhatsApp Business de Meta. Al registrarse, el Cliente provee información veraz, completa y actualizada.
El Cliente se compromete a usar HABLALO exclusivamente para comunicaciones legítimas de negocio a través de WhatsApp Business, y a cumplir en todo momento con:
El Cliente no puede usar el Servicio para: enviar spam o mensajes masivos no solicitados; distribuir contenido ilegal, fraudulento, engañoso o que infrinja derechos de terceros; intentar eludir o vulnerar la seguridad de la plataforma; revender o sublicenciar el Servicio sin autorización escrita.
El Cliente es el único responsable de: obtener consentimiento válido de sus Usuarios Finales antes de enviarles mensajes; el contenido de todos los mensajes enviados a través de la plataforma; el cumplimiento de las leyes de privacidad y protección de datos aplicables a sus conversaciones; gestionar las solicitudes de sus Usuarios Finales (acceso, rectificación, eliminación de datos).
El Cliente es responsable de mantener la confidencialidad de sus credenciales de acceso y de todas las actividades que ocurran bajo su cuenta. El Cliente notificará de inmediato a HABLALO ante cualquier uso no autorizado de su cuenta o brecha de seguridad.
HABLALO puede suspender o terminar el acceso del Cliente al Servicio, con o sin previo aviso, si: el Cliente viola estos Términos o las políticas de Meta; la cuenta del Cliente es suspendida o baneada por Meta/WhatsApp; el Cliente no paga las tarifas del servicio. El Cliente puede cancelar su suscripción en cualquier momento a través de los canales de soporte.
HABLALO y todo su contenido, marca, logotipos y tecnología son propiedad de Francisco Javier Jaramillo LLC o sus licenciantes. El uso del Servicio no otorga al Cliente ningún derecho de propiedad sobre el Servicio ni sobre su contenido. El Cliente conserva la propiedad del contenido de sus conversaciones y datos de sus Usuarios Finales.
EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY APLICABLE, HABLALO / FRANCISCO JAVIER JARAMILLO LLC NO SERA RESPONSABLE POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES O CONSECUENTES, INCLUYENDO PERDIDA DE BENEFICIOS, DATOS O REPUTACIÓN, QUE RESULTEN DEL USO O LA IMPOSIBILIDAD DE USO DEL SERVICIO. LA RESPONSABILIDAD MAXIMA ACUMULADA DE HABLALO NO SUPERARA EL MONTO PAGADO POR EL CLIENTE EN LOS 3 MESES ANTERIORES AL EVENTO QUE DA LUGAR A LA RECLAMACION.
EL SERVICIO SE PROVEE "TAL CUAL" Y "SEGUN DISPONIBILIDAD", SIN GARANTIAS DE NINGUN TIPO, EXPRESAS O IMPLICADAS. HABLALO NO GARANTIZA QUE EL SERVICIO SEA ININTERRUMPIDO, LIBRE DE ERRORES O QUE CUMPLA REQUISITOS ESPECIFICOS DEL CLIENTE.
HABLALO no es afiliado, asociado, autorizado, apoyado ni patrocinado por Meta Platforms, Inc. o WhatsApp LLC. El Servicio depende de la disponibilidad de la WhatsApp Business Cloud API, y cambios en las políticas o disponibilidad de Meta pueden afectar el Servicio sin responsabilidad de HABLALO.
HABLALO se reserva el derecho de modificar estos Términos en cualquier momento. Notificaremos cambios materiales por email o mediante aviso en la plataforma con al menos 7 días de anticipación. El uso continuado del Servicio tras la notificación constituye aceptación de los nuevos términos.
Estos Términos se rigen por las leyes del estado de Florida, USA, sin dar efecto a principios de conflicto de leyes. Cualquier disputa se someterá a la jurisdicción exclusiva de los tribunales competentes de St. Johns County, Florida.

By registering and using HABLALO (the "Service"), you ("Client") agree to be bound by these Terms of Service. If you do not agree to any of these terms, do not use the Service. These terms constitute a legal agreement between the Client and Francisco Javier Jaramillo LLC, operating under the trade name Gain With Media, based in St. Augustine, Florida, USA.
HABLALO is a WhatsApp Business automation platform that allows businesses to connect their WhatsApp Business number to automation tools, including AI-powered responses, conversation management, message templates, and human agent assignment. The Service operates through the WhatsApp Business Cloud API provided by Meta Platforms, Inc.
To use HABLALO, the Client must: (a) be a legal entity or individual with full contractual capacity; (b) be at least 18 years old; (c) own or be authorized to use the registered WhatsApp Business number; (d) comply with Meta's WhatsApp Business Platform Policies.
The Client agrees to use HABLALO exclusively for legitimate business communications via WhatsApp Business, and to comply at all times with:
The Client may not use the Service to: send spam or unsolicited bulk messages; distribute illegal, fraudulent, misleading, or infringing content; attempt to bypass platform security; resell or sublicense the Service without written authorization.
The Client is solely responsible for: obtaining valid consent from End Users before messaging them; the content of all messages sent through the platform; compliance with applicable privacy and data protection laws; managing End User requests (access, rectification, data deletion).
The Client is responsible for maintaining the confidentiality of their access credentials and all activities under their account. The Client will promptly notify HABLALO of any unauthorized use or security breach.
HABLALO may suspend or terminate Client access with or without notice if: the Client violates these Terms or Meta's policies; the Client's account is suspended or banned by Meta/WhatsApp; the Client fails to pay service fees. The Client may cancel their subscription at any time through support channels.
HABLALO and all its content, branding, logos and technology are the property of Francisco Javier Jaramillo LLC or its licensors. Use of the Service grants no ownership rights. The Client retains ownership of their conversation content and End User data.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HABLALO / FRANCISCO JAVIER JARAMILLO LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA OR REPUTATION. HABLALO'S MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE CLIENT IN THE 3 MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. HABLALO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET THE CLIENT'S SPECIFIC REQUIREMENTS.
HABLALO is not affiliated with, associated with, authorized by, endorsed by, or sponsored by Meta Platforms, Inc. or WhatsApp LLC. The Service depends on the availability of the WhatsApp Business Cloud API, and changes to Meta's policies or availability may affect the Service without liability to HABLALO.
HABLALO reserves the right to modify these Terms at any time. We will notify Clients of material changes by email or platform notice at least 7 days in advance. Continued use after notification constitutes acceptance.
These Terms are governed by the laws of the State of Florida, USA. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of St. Johns County, Florida.
